Green Card Renewal or Replacement Form I-90

On September 5, 2017, the Department of Homeland Security issued a memorandum rescinding Deferred Action for Childhood Arrivals “DACA.” Effective immediately USCIS will no longer accept initial DACA applications. Renewal applications will be accepted until October 5.

If you have never previously held DACA status, you can no longer apply under this program. If you have previously held DACA status then you can apply to renew your status if your current Employment Authorization Document (EAD) will expire between September 5, 2017 and March 5, 2018.

Deferred Action is a program for undocumented immigrants created in 2012 through an executive action by President Barack Obama. It offers protection from deportation for two years and a two-year work permit.

November 2014, Obama expanded DACA through another executive order. Expanded DACA will extend the program from two years to three years and the eligibility requirements will change so that more people qualify. The USCIS had planned to release the application in February 2015. However, due to recent events, the release has been temporarily postponed.

There are several eligibility requirements for DACA including an education requirement, an age requirement and a required amount of time spent living in the U.S.

new Expanded DACA application will change these requirements, making more people eligible. For example, there will no longer be an upper age requirement.
